Introduction
These Terms of Service ("T.O.S.") set forth the legally binding terms for your use of CharacterMarket.AI and any affiliated websites, platforms, products, or services (collectively, the "Services").
The Services are owned and operated by CharacterMarket.AI, registered in Washington state, United States.
By accessing or using the Services you agree to these T.O.S. and all policies published at https://CharacterMarket.AI/. If you do not agree, please stop using the Services.
Our Services are a marketplace for Creators to offer AI characters, personas, lorebooks, artwork, and related services, and for Customers ("users") to browse and purchase them.
1. General
CharacterMarket is a marketplace for character cards, personas, lorebooks, and related artwork. Customers may purchase pre-made or custom-made work.
We may de-list characters, personas, lorebooks, artwork, or other content at any time at our sole discretion or by legitimate request.
1.1 Account
- You must use your own login credentials and are responsible for all activity under your Account.
- Your Account is non-transferable and may not be sold, lent, or shared.
- You represent that registration information is true and correct and agree to keep account information current.
- You must protect your password and prevent unauthorized access.
- We may require additional verification, including proof that you are an adult.
- Violations may result in account cancellation, restriction, or termination without liability to you or third parties.
1.2 User Safety
Do not disclose sensitive personal information (financial details, addresses, contact information, or passwords) through the Services.
Report suspicious or inappropriate behavior so we can maintain a safe environment.
1.3 Warranties
- You are entering into these T.O.S. only on your own behalf.
- You are of legal age to form a binding contract in your jurisdiction.
- If you are under the legal age in your jurisdiction, you may not use the Services.
2. Intellectual Property
Platform technology, systems, software, branding, and materials are owned by or licensed to CharacterMarket.AI. You receive a personal, non-transferable license to access the Services.
Unauthorized reproduction, modification, distribution, or use of our intellectual property may result in legal consequences.
3. Your Content
You retain ownership of your input. To operate the Services, you grant CM a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, distribute, modify, display, and create derivative works of your content as described in our Privacy Notice—including compliance checks and promotional uses consistent with your privacy preferences.
4. Restrictions of Conduct and Content
4.1 Rules and restrictions
- Do not modify, reverse-engineer, or circumvent security features of the Services.
- Do not use the Services to gain unauthorized access, cause harm, violate laws, or infringe rights.
- Do not remove or obscure proprietary notices.
- Comply with all applicable laws in your jurisdiction.
4.2 Incidents and User Actions
CharacterMarket.AI is not responsible for actions users take following interactions with AI characters, scenarios, or related products. Use your own judgment.
4.3 Content Moderation and Removal
Flagged content may be manually reviewed. We may remove content, terminate accounts, or report violations to authorities. Repeated violations may result in restrictions without refund.
We may de-list or modify features or content at our discretion without refund for removed or modified items.

4.4 Prohibited Content Reporting
We have a zero-tolerance policy for CSAM. Known CSAM is reported to the National Center for Missing and Exploited Children or other appropriate authorities. See our Blocked Content Policy.

6. Payments
All payments are processed by Stripe, a third-party payment provider.
7. Fulfillment policy
7.1–7.2 Cancellation & access
Users may cancel during the creation period if unsatisfied. Upon cancellation, access to the creation is lost.
7.4 Refund policy
If you cancel a contract without dispute, funds are refunded within 24 hours where applicable.
No refunds are provided for moderated or removed content, enforcement actions, or platform changes that do not alter core services within the meaning of applicable law.
8. Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CM AND ITS LICENSORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
9. Governing Law and Dispute Resolution
These T.O.S. are governed by the laws of the United States of America without regard to conflict-of-law principles.
Disputes shall be resolved by the courts of the state of Washington, United States.
10. Changes to Terms and Policies
We may update these T.O.S. and other policies at any time. Continued use after changes are posted constitutes acceptance. Stop using the Services if you do not agree.
11. Complaint Policy

12. Termination and Assignment
You may terminate by ceasing use of the Services. We may terminate access with or without notice for violations or other reasons. We may assign or subcontract the Services with notice on the platform.
13–14. Miscellaneous
If any provision is unenforceable, the remainder stays in effect. These T.O.S. constitute the entire agreement regarding use of the Services.
