CharacterMarket.AI ("CM", "Market", "we", "us", or "our") is the Controller for processing implemented through this website at https://CharacterMarket.AI/ and any affiliated websites to which visitors or users may be redirected (the "Services"). CM is incorporated in the Republic of Washington, United States, registered at 26 Kidwell RD, Republic WA 99166.

The Service is an online niche marketplace that allows Creators to display AI-related creations—such as characters, scenarios, lorebooks, or artwork—for Users to purchase as pre-generated assets or to request wholly unique work.

This Privacy Notice explains how CM collects, uses, discloses, and handles your Personal Data. It also describes your rights under applicable data protection law, including the EU GDPR, UK GDPR, and Swiss FADP where applicable.

By using the Services, you agree that you have read and understood this Privacy Notice.

1. Definitions

  • "Content": information you provide to register as a User and/or while using our Services, including Personal Data.
  • "Consent": a freely given, specific, informed, and unambiguous indication of agreement to Processing of your Personal Data.
  • "Controller": the entity that determines the purposes and means of Processing—in this case, CM.
  • "Personal Data": information provided while registering or otherwise identified as personal data under applicable law.
  • "Processing": any operation performed on data, such as collection, storage, use, disclosure, or deletion.
  • "Subscription": an arrangement between CM and you to use the Services.
  • "User", "you", and "your": a person using the Services with an account.
  • "Visitor": anyone browsing the Services without creating an account or logging in.

2. Purposes of Personal Data Processing

We process Personal Data according to the legal bases described below. If you do not provide required data, we may not be able to provide the Services.

Account creation & management

We process email address, encrypted password, nickname/username, currency and location signals (including IP-based country/city), account timestamps, sign-in history, and sign-in counts to register and manage User and Creator accounts.

Legal basis: performance of a contract and compliance with legal obligations; legitimate interest in addressing your questions and concerns.

Service and support

We process contact form data, email addresses, device and browser information, relevant Content, and cookies to investigate issues and provide support.

Legal basis: legitimate interest in providing timely, accurate support.

Quality assurance, analytics & debugging

We may de-identify or anonymize data, query systems for QA, analyze aggregated usage trends, and review log files (including user IDs and timestamps) to maintain platform reliability. Log files are automatically deleted after 30 days.

Legal basis: legitimate interest in providing a reliable and stable platform; detecting errors, misuse, and security threats.

Payment processing

Payments are processed by Stripe. CM releases funds after both Creator and User are satisfied with a sale, typically within 24 hours or sooner. Stripe may process name, email, card brand, last four digits, transaction metadata, IP address, and related payment fields.

Legal basis: necessary for payment services.

Direct marketing

With opt-in consent, we may send marketing emails about updates, offers, and features. You can unsubscribe at any time. Opting out of marketing does not affect service-related communications.

Legal basis: legitimate interest in improving Services; consent where required.

Safety and moderation

We review flagged Content and accounts, take enforcement actions, ensure policy compliance, and report unlawful activity—including CSAM—to appropriate authorities when required.

Legal basis: legal obligations; performance of contract; legitimate interest in preventing misuse.

3. Marketing

We may send marketing notifications about our Services, including alerts, newsletters, emails, and event invitations.

To unsubscribe: use the link in a marketing email or contact us using the details in Section 11 below.

4. Third Party Marketing

CharacterMarket.AI does not use third-party marketing.

5. Sharing your Personal Data

We may share your information with payment service providers (only what is necessary for transactions), professional advisers, legal and regulatory authorities when required, and our employees as needed for their work.

We will not disclose, sell, trade, or otherwise transfer your Personal Data to third parties for unrelated purposes.

6. Retention Period

We retain Personal Data only as long as your account exists or as needed to provide the Services, unless a longer period is required by law.

When you terminate your account, we will make reasonable efforts to remove account-related information. Retention periods may change based on business or regulatory requirements, and we will update this Notice accordingly.

7. Personal Data of minors

CharacterMarket.AI does not provide Services to anyone under 18 years of age (or the equivalent minimum age in your jurisdiction). If we learn that an underage individual misrepresented their age, we will delete the information and block the account.

8. Your rights under the GDPR

Depending on your location, you may have rights to access, rectify, erase, restrict, port, withdraw consent, or object to certain Processing—including direct marketing. You may also lodge a complaint with your supervisory authority.

You may request a copy of Personal Data we hold about you.

You may request correction of inaccurate or incomplete data.

8.3 Right to erasure

You may request deletion in certain circumstances, subject to legal exceptions.

You may request suspension of Processing in specific scenarios.

8.5 Right to portability

You may request a machine-readable copy or transfer where applicable.

8.7–8.8 Right to object

You may object to Processing based on legitimate interests or for direct marketing.

9–10. Transfers & safeguards

You may request information about safeguards used for transfers of Personal Data outside the EU, UK, or Switzerland, redacted of unrelated terms.

We may revise this Notice from time to time. Material changes will be posted on the Services with an updated revision date and, where appropriate, notified by email or in-product notice. Continued use after changes take effect constitutes acceptance.
